Last updated: October 23, 2026
1. About these terms
These Terms and Conditions govern your access to and use of apexplayers.com and every page, form and piece of content on it (the "Website"). The Website is operated by Apex Marketing inc., doing business as Apex Player Media ("Apex", "we", "us" or "our"), based in Québec City, Québec, Canada.
By browsing the Website or sending us a request through it, you agree to these terms. If you use the Website on behalf of a company, studio or other organization, you confirm that you are authorized to accept these terms for it. If you do not agree, please do not use the Website.
2. Who the Website is for
The Website presents our performance marketing and player acquisition services to game studios, publishers and other businesses. It is not directed at consumers or at anyone under the age of majority in their place of residence.
3. Information on the Website
Content on the Website, including descriptions of services, channels, timelines, budgets and pricing models, is general information about how we usually work. It is not an offer, a quote or a guarantee of results.
Any services we provide are governed by a separate written agreement signed with each client, such as a service agreement or insertion order. If that agreement conflicts with anything on the Website, the agreement prevails.
We work to keep the Website accurate and current, but we may change, update or remove content at any time without notice.
4. Contact requests
When you send us a request through the contact form or by email, you agree to give accurate information and to have the right to share it. We use it to answer you and to discuss a possible project. Sending a request does not create a client relationship, and we may decline any project at our discretion.
Please do not send confidential information, such as unreleased game details, financial data or access credentials, until a confidentiality or service agreement is in place between us.
5. Acceptable use
You agree to use the Website lawfully and in good faith. In particular, you agree not to:
- attempt to gain unauthorized access to the Website, its servers or any connected system;
- interfere with the Website's operation or security, including by introducing malicious code or overloading it with requests;
- collect content or data from the Website with automated tools such as bots, crawlers or scrapers, except for standard search engine indexing;
- submit false, misleading or automated requests through our forms; or
- use the Website to send unsolicited advertising or to impersonate any person or organization.
6. Intellectual property
The Website and its content, including text, graphics, illustrations, visual design, code and the Apex Player Media name and logo, belong to Apex Marketing inc. or its licensors and are protected by Canadian and international intellectual property laws.
You may view the Website and share links to it. You may not copy, reproduce, modify, republish or distribute its content, in whole or in part, without our prior written permission.
Names and logos of game studios, platforms and advertising networks shown on the Website belong to their respective owners. Showing them does not mean that those owners sponsor or endorse Apex.
7. Third-party sites and services
The Website may link to, or rely on, services operated by third parties, such as form processing, font hosting and the advertising platforms we describe. We do not control those services and are not responsible for their content, availability or practices. Your use of them is governed by their own terms.
8. Personal information
We handle personal information in accordance with applicable privacy laws, including the Act respecting the protection of personal information in the private sector (Québec) and, where it applies, the Personal Information Protection and Electronic Documents Act (Canada). Our Privacy Policy explains what we collect, why we collect it and how you can exercise your rights.
9. Disclaimer
The Website is provided "as is" and "as available". To the extent permitted by law, we make no warranty that it will be uninterrupted, error-free or free of harmful components, or that its content is complete or suited to your needs. Marketing results depend on many factors outside our control, and nothing on the Website promises a specific outcome.
10. Limitation of liability
To the extent permitted by law, Apex will not be liable for any indirect, incidental, special or consequential loss, including lost profits, revenue, data or business opportunities, arising from your use of the Website or your reliance on its content.
Nothing in these terms excludes or limits liability for bodily or moral injury, or for damage caused by intentional or gross fault, where Québec law does not allow it.
11. Indemnity
If you breach these terms, you agree to compensate Apex for any claims, losses or costs, including reasonable legal fees, that result from that breach.
12. Changes to these terms
We may update these terms from time to time. The date at the top of this page shows when they last changed. Using the Website after an update means you accept the updated terms.
13. Governing law
These terms are governed by the laws of the Province of Québec and the federal laws of Canada that apply there. Any dispute relating to the Website will be brought before the competent courts of the judicial district of Québec, unless the law requires otherwise.
14. Language
These terms are available in English and French. Both versions have the same legal value.
15. General
If any part of these terms is found invalid or unenforceable, the rest remains in effect. If we do not enforce a right under these terms, we do not waive it. These terms are the entire agreement between you and Apex about your use of the Website, and they do not replace any signed agreement for our services.
